Rental Terms & Liability Disclaimer
Effective from: 1st February 2026
These Rental Terms and Liability Disclaimer govern all equipment rentals provided by Tiny Pits and Play, including but not limited to soft play equipment, ball pits, bounce houses, and related accessories.
By renting equipment from Tiny Pits and Play, the client agrees to all terms outlined below.
5.1 DEFINITIONS
For clarity within this policy:
- “Company” refers to Tiny Pits and Play
- “Client” refers to the individual or organization renting equipment
- “Equipment” includes all soft play items, ball pits, bounce houses, mats, fences, and accessories
- “Event” refers to the time and location where equipment is used
5.2 RENTAL ELIGIBILITY AND BOOKING REQUIREMENTS
To rent equipment, clients must:
- Be at least 18 years old
- Provide accurate contact and event information
- Sign all required agreements, including liability waivers
- Submit full payment or required deposit before delivery
Tiny Pits and Play reserves the right to refuse service at its discretion.
5.3 RENTAL PERIOD AND USAGE TIME
All rentals are for the agreed rental duration only.
- Rental time begins upon delivery or setup
- Equipment must be available for pickup at the agreed time
- Overtime use may result in additional charges
Unauthorized extension of rental time is not permitted.
5.4 SETUP AND SPACE REQUIREMENTS
Clients are responsible for ensuring adequate space for safe setup.
- Space requirements must meet or exceed listed minimums
- Surfaces must be flat, dry, and free of hazards
- Indoor setups must allow clear access paths
Tiny Pits and Play may refuse setup if conditions are unsafe, with no refund.
5.5 DELIVERY, SETUP, AND BREAKDOWN
Unless otherwise agreed:
- Tiny Pits and Play handles professional setup and breakdown
- Clients may not move or alter equipment
- Equipment must remain in its original setup position
Unauthorized movement voids liability protection.
5.6 SUPERVISION RESPONSIBILITIES
Adult supervision is required at all times.
- At least one responsible adult must actively supervise
- Staff supervision is not included with rentals
- Children must never be left unattended
The client accepts full responsibility for participant supervision.
5.7 PROPER USE OF EQUIPMENT
All equipment must be used as intended.
Prohibited actions include:
- Rough play or pushing
- Overcrowding equipment
- Using equipment outside recommended age ranges
- Food, drinks, or sharp objects on equipment
Misuse may result in immediate termination of rental without refund.
5.8 HEALTH AND SAFETY COMPLIANCE
Clients must ensure participants are healthy enough to play.
- Sick children should not use equipment
- Shoes are not permitted on soft play
- Socks are recommended
Tiny Pits and Play is not responsible for illness transmission.
5.9 DAMAGE, LOSS, AND CLEANING RESPONSIBILITY
Clients are responsible for equipment care during the rental period.
Clients will be charged for:
- Damage beyond normal wear
- Missing components
- Excessive cleaning due to spills or misuse
Costs will be assessed at replacement or repair value.
5.10 WEATHER AND ENVIRONMENTAL CONDITIONS
For outdoor rentals:
- Equipment must not be used in rain, high winds, or extreme heat
- Equipment must be kept dry and secure
Use during unsafe conditions voids all liability protection.
5.11 CANCELLATION DUE TO UNSAFE CONDITIONS
Tiny Pits and Play reserves the right to cancel or stop use if:
- Weather becomes unsafe
- Equipment is misused
- Supervision is inadequate
Safety decisions are final and non-negotiable.
5.12 ASSUMPTION OF RISK
The client understands and agrees that:
- Physical play involves inherent risks
- Minor injuries may occur during normal use
- Participation is voluntary
By renting equipment, the client assumes all risks associated with its use.
5.13 LIABILITY WAIVER AND RELEASE
The client releases Tiny Pits and Play from:
- Claims of injury, illness, or property damage
- Losses resulting from normal use
- Incidents caused by misuse or negligence
This release applies to the company, owners, staff, and affiliates.
5.14 INDEMNIFICATION
The client agrees to indemnify and hold harmless Tiny Pits and Play against:
- Claims arising from equipment use
- Third-party injuries
- Violations of these terms
This includes legal fees and related expenses.
5.15 NO LIABILITY FOR THIRD-PARTY ACTIONS
Tiny Pits and Play is not responsible for:
- Actions of guests, vendors, or venue staff
- Improper supervision by the client
- Venue-related hazards
Liability remains with the client.
5.16 FORCE MAJEURE
Tiny Pits and Play is not liable for delays or cancellations caused by:
- Severe weather
- Natural disasters
- Power outages
- Government restrictions
Refunds or rescheduling will be handled per company discretion.
5.17 LIMITATION OF LIABILITY
Under no circumstances shall Tiny Pits and Play be liable for:
- Indirect or consequential damages
- Loss of enjoyment or event disruption
- Amounts exceeding the rental fee paid
5.18 GOVERNING LAW
These terms are governed by the laws of the State of Texas.
Any disputes shall be resolved in Texas courts.
5.19 AGREEMENT ACKNOWLEDGMENT
By signing or accepting delivery of rented equipment, the client confirms:
- They have read and understood these terms
- They agree to all conditions
- They accept full responsibility during the rental period
